In a very recent trial in the New York Supreme Court, Bronx County, the trial judge permitted the jury to consider and make a finding that the defendant physician had acted in a willful, harmful manner during treatment characterized as "experimental" by plaintiff's counsel. There was a seven figure award for compensatory damages, and the same trial jury is returning soon to consider the value of an award for punitive damages. I am interested in reading a trial transcript or other pertinent material concerning presenting a defense before a jury on this issue. Any recommendations?
